Warranty issue.

Hi ,

I was facing issue in the microphone as the voice on the other side when making the calls was not audible. I visited the service centre and told the same. The reply was that they wont accept the phone in warranty. I reason they gave was that there were scratches in the panel and hence it voids the warranty. There was no liquid damage.

I fail to understand when the outer body is made of plastic material the scratches will be there. This doesnot account to be physical damage. My phone is in white colour and hence, the scratches are easily visible. Can you explain me how is this possible, rejecting warranty on basis of scratches. There was no broken screen or anything. How does this account for physical damage and warranty rejection?

Please revert back as soon as possible.

Are you in the UK if you are I could give you help on consumer law about this as I recently took The Carphone Warehouse to court and won regarding a simalar issue

Thanks Thommo for the reply.

I am in India. But there must be some consumer laws about this. I also failed to understand how scrathes on outer body of phone will void warranty of the microphone, when the outer body is plastic material.

Btw can you please tell me what was the petition you filed and what consumer law was used to give you the relief?

I think Thommo is refering to the seller of the product. Who sold you the phone? Did Sony Service Centre examine the phone? Can you provide the Sony Service Centre that attended to you? Maybe the staff here is able to get their Indian counterpart to help.

Sony should under manufacturing law repair your phone and should not decline if and I say if taking into account what you say about the light scratches being on the outer casing - If this is so then your phone should be repaired as this comes under the heading of acceptable defect however the final decision is Sony's but if after pointing out that this is deemed acceptable damage and they still fail or are unwilling or even offer to repair it as a goodwill gesture then if it were here in the UK you would then ask for a deadlock letter which enables you to pursure a claim via the courts this is the route I took and won
